What if I cannot apply for PR?

This post is for people who are interested in studying in Australia, are currently studying in Australia or about to finish their degrees from an Australian University.
Now that you have finished your degree, you would be interested in getting some valuable Australian work experience by working in your related field of profession.


Most students who have planned their stay and studies well would be able to apply for Permanent Residency which gives them lots of room for applying for jobs relevant to their fields.

But if you are one of those unlucky ones who didn't plan their stay and now find themselves in a situation where you cannot apply for Permanent residency, and you also want to get some work experience in your own field before you return back to your home country, then here are a few tips and tricks for you.

1. First of all, dont lose heart if you cannot fetch enough points of PR. There are lots of other visa schemes which can help you out like state sponsored nominated and employer sponsored etc. Talk to a lawyer and may be he can tell you of a way out.

2. If you have no other options, then you can always apply for a Graduate skilled visa.

Skilled – Graduate (Temporary) visa (subclass 485)
An 18 month temporary visa for overseas students who have obtained an Australian qualification in Australia as a result of at least two (2) years study. Allows applicants who are unable to pass the points test to remain in Australia for 18 months to gain the skills and experience needed to apply for a permanent or provisional General Skilled Migration visa. No points test applies.

The 485 temporary graduate skilled visa is only being offered to students who are eligible for transitional arrangements.

Transitional arrangements for students and former student visa holders were announced on 8 February 2010, the day on which the Australian Government announced a number of skilled migration reforms. These transitional arrangements are in place until 31 December 2012.
You are eligible for transitional arrangements in relation to points tested skilled migration if:
  • on 8 February 2010 you held a Skilled - Graduate (Subclass 485) visa
    or
  • on or before 8 February 2010 you made a valid application for a Skilled - Graduate (Subclass 485) visa and the visa application has not been finally determined
So if you are not part of the transitional arrangements then you will not be able to apply for the graduate skilled visa.

Please note that you can only apply for the graduate skilled visa if and only if you have studied for two years in Australia. Please make sure you understand what the two years rule means. I have explained that in another post. Visit the link to get and understanding of it.

So this 18 months graduate skilled visa gives you the option of staying and working in Australia. Now its up to you to get a job and get work experience in your own field.

You might also be able to claim extra bonus points based on your work experience and actually be able to apply for permanent residency later on.

To be short and quick.

If you have completed your four years undergraduate degree from outside Australia, then you have to have a valid 3/4 years experience before you can apply for PR.

Having a PR (permanent residency) gives you full time work rights in Australia and then you can live and work in Australia freely. Its like the American green card.

I will confirm whether it is 3 or 4 years later on.

All IT professionals and Engineering professionals MUST have 3/4 years valid work experience in their profession or CLOSELY RELATED field, before they can apply for PR. This experience must be AFTER graduating from university and must be paid work experience.

I will be providing a detailed post on this topic very soon.

The bottom line is that either you spend lots of money in Australia over your post graduate degree OR you work in your own country for 3/4 years and then apply for PR.

Is there any other way?

Yes, you can get yourself sponsored by an employer (post on this coming soon) who can then apply on your behalf and get you a work visa.

This is the best option but it is difficult to get. Especially if you are a fresh graduate from a university.

Yes, the prospects for overseas engineering graduates are very good. Provided, that you have the appropriate skills, you can prosper very well and have a very well paid job.

If you are good at your profession, you should be expecting a salary of 100 K after 4 or 5 years of industry experience.

If you can get this valuable experience before you come here, it would be a very smooth ride for you as getting into the job market is not easy for fresh graduates.

You will be best off working in aged health care facilities as a start.

There are lots of jobs for people with a medical background or social service background to join aged care health facilities as an aged care health worker.

Just do a google search on aged care health facilities in Australia and you will get a long list of companies which provide these services. You can easily get a job in such places.

I dont know what type of social service background you have.

If you can explain to me what social service background you are talking about.

Yes. After completing your initial 1.5 years of study, you can enrol in another 6 months of degree/trade certificate/diploma to complete the 2 years study requirement.

Yes, you can also move to another city and change your education provider.


However, after 1.5 years of study, if you enrol in 6 months of study, you will get a visa with NO FURTHER STAY stamped on it.

A no further stay visa would mean that you can no longer apply for another visa in Australia except for the following

1. A graduate skilled visa which is for 18 months and gives you the opportunity to work in Australia for 18 months. You can work in your field of profession for at least 12 months and then apply for PR on the basis of that experience.

2. Another student visa.

To avoid this hassle, the best would be to enrol in a 2 year degree.

The first thing you need to understand is that to be able to apply for PR, you need to be from a profession which is listed on the SOL/MODL.

If you have skills in a profession other then the one listed on the MODL/SOL, then you cannot apply for PR.

So before you decide to enrol in a degree, make sure that you take up a degree which is CLOSELY related to a profession listed on the SOL/MODL.

After finishing the degree, you will also have to get a positive skills assessment from your concerned assessing body. So also make sure that you can fulfill the criteria of your assessing body. Some times the requirements of the immigration department and that of the assessing body differ and can cause a problem.

Now coming to your question of 1.5 yrs of course.

You should keep in mind the following if you want to apply for PR on the basis of two years of education in Australia.

1. You should have studied in an Australian university for 92 weeks and the result of your study should have resulted in degrees/trade certificates or Diplomas.

2. If you enrol in a 1.5 yrs degree, then you will have to enroll in another trade certificate or Diploma , RELEVANT TO YOUR PREVIOUS DEGREE AND YOUR PROFESSION ON THE SOL.

The only problem is that if you only enrol in a 6 months course like a trade certificate, you will get a NO FURTHER STAY stamoped on your new student visa.

That would mean that although you would be able to fulfill the 2 yr study requirement, but you wont be able to apply for PR at the end of your 2 yrs tenure.

However, you would be able to apply for another student visa OR a graduate skilled visa.

So if you end up in such a situation, your best course of action would be to apply for a graduate skilled visa which gives you full time work rights for 18 months.

Then during those 18 months, you must get a job in your own profession and at least work for 12months.

If you are able to do that then you can apply for PR after that.



So here is the summary:

1. You enrol in a 1.5 yrs course.

2. You finish the 1.5 yrs course.

3. You enrol in another 6 months course and get a new student visa. In case you dont have no further stay on your visa then you directly apply for PR. If you do have NO FURTHER STAY on your visa then you move on to step 4.

4. You finish the 6 months course.

5. You apply for graduate skilled visa which is for 18 months.

6. You work in your own profession for 12 months atleast out of the 18 months.

7. You apply for PR based on your work 1 yr experience in Australia.


Hope this solves your issue.

Remember that you can only get a graduate skilled visa after 2 years of study.

That will cost you more but after that you will be able to directly apply for PR.

On the other hand you can apply for graduate skilled visa and then work for 18 months and then again apply for PR.

If you want to apply for PR as an international student you need to know the following.

1. You should have studied in Australia as a full time international student for two yrs.

2. After completing your degree, you should choose a profession on the SOL/MODL which is CLOSELY related to your degree.

3.You should be able to get a positive skills assessment for the profession you have chosen on the SOL/MODL.

4. Be able to obtain the required number of points to obtain PR.

Now coming to your questions.

Is an electronics related profession listed on the SOL/MODL.

Please check the SOL/MODL from this weblink and let me know if there is any profession listed which you think would be closely related to the degree you intend to do in Australia?

So if there is no profession on the SOL/MODL which is closely related to the degree you intend to do in Australia, then you should choose a degree which is CLOSELY related to a profession on the SOL/MODL.

Can you share some information on this topic...as most of people are unaware of this point and consider that after 2 yrs of Aussie degree they are assure of getting the 60/40 odd PR points

I had done some research on this and understand that after 2 yrs of study, one has to clear the skill assessment test, SO
its not the 2 yrs study that helps in getting the bulk of PR points but clearing the SKILL assessment test which does the job.

Pls advice.

I have a question, which probably have been asked before, but it was a kind of different situation here.

I'm taking a double degree (B.Bus and B.Comp) in UTS. I've completed my first 3 years back in Malaysia and transferred here to finish the rest of 1.5 years.

Apparently, that means I have 1.5 years of study period in Australia.

Now, I am planning to take the Industrial Training course program in UTS (they called it a diploma in professional practice or something like that), and the duration will be 9 up to 12 months.

If the duration of this diploma/industrial training is added to my 1.5 years period, that means i have 2years ++.. correct me if I'm wrong.

I am planning to choose computer as my career, or maybe business analyst/finance related career.. based on my degree..

Now what is my chance of getting the PR or TR??

The process of getting PR for international students is as follows

1. You study in a course which is CLOSELY RELATED to a profession on the SOL/MODL, for a duration totalling at least 92 weeks.

2. Once your studies are finished, you get yourself assessed by the relevant assessing body.

Every assessing body has its own requirements, so you should read the guide lines provided by your assessing body.

For engineers, the assessing body is Engineers Australia, for IT professionals it is Australian computer society , for doctors it is Australian medical council and so on.

3. Once you get a positive skills assessment from your assessing body, you lodge an application for PR.

Your chances of getting PR depends on the points you score.

If you can score above 120, you will get PR.

You must chose a profession on the SOL/MODL which is closely related to your degree(s).

If you are scoring less then the pass marks, then you can get a graduate skilled visa, for 18 months after completing two yrs of education.


If you can work for at least 12 months out of those 18 months in a field related to a profession on the SOL/MODL, then you can apply for PR on the basis of that 1 yr of work experience.

So every thing would depend if you can get a job or not.

I am Anup from India and I am planning to apply to Australian univ's for a master's degree in something related to Networking..I am planning to apply to 3 universities-
1) La trobe- master of science in Networking
2) Swinburne-Master of Science(Network Systems)
3)Curtin University-Master of science in Communication Networks

I need ur opinion on the colleges that i've chosen.I really have my doubts about Swinburne,though the fees is less but its nowhere in the rankings.What about La-trobe and Curtin..how are they rated in Oz and what about PR and job oppurtunities?I have done my engineering(4 years)in 2006 and currently working in a reputed IT company in a networking profile.
I know that you have also studied master's in internetworking from UTS..i thought of applying to that course..but the fees is more than what i can afford. Also,pls let me know if you are aware of any other universities which provide good master's degree in networking as I am sure you must have a good amount of research before applying to UTS..so waiting for your advise.

By the time you finish your 2 years education in Australia, your three years work experience would have become invalid.

The department of immigration website says

To meet the recent work experience requirement, you must demonstrate that you have been employed in an occupation on the Skilled Occupation List (SOL) for 12 of the 24 months immediately before lodging your visa

So you have two options.

1. Apply for offshore immigration visa subclass 175 and later on if you want to come to study, you can also come to study while your 175 application is processed.

2. Come to Australia, study for two years and then apply for visa subclass 885 but then you will be running short of points as your work experience would have become invalid.

I am Technical Writer in India, already a Post Graduate, with 2 years work ex with a top IT company. Unfortunately for me, there is no 2 year course in technical communication in Australia (like an MS). Most are and year to an year and a half. In this case, suppose I do such a course and do not enrol for a different course to complete 2 years, what is the way in which I can get a PR?

What exactly is your purpose?

Just immigration or study plus immigration?

What is the profession on the SOL that closely resembles what you have been involved with?

Yes, in your case, you will have to complete your PhD before you can apply for visa subclass 885.

You could have applied for offshore visa 175 but that requires you to have at least one year of work experience in your nominated profession before you can apply for offshore immigration.

So, depending upon what your profession is, you will be able to apply for offshore immigration.

Anyway, i want to ask you something about my case.Hope you will able to suggest me best thing to do. I have completed my B.tech in computer science. And having 2.3 years working experience from research and development field from CDAC Noida. Now i got admission in MEM(Master of engineering management)1 year course in UTS and joining at feb 2009.(I have to apply for this 1 year programme due to finacial problem,but wanted to enroll for MEM/MBA dual degree programe). Now as you said , that to getting Pr we must have 2 year duration education from Australia,So i must have to enroll myself in MBA programe after completion of my MEM programe on extended visa option.would it be great idea to do so, or i will get PR just after getting my MEM programe from UTS?

To apply for onshore migration as an international student, you need to study in Australia for 2 yrs in a course which is closely related to a profession on the Skilled Occupation List.

If you study for one yr in a course, then you do not fulfill the two yr requirement and hence cannot apply for PR.

You need to study in a degree or degrees for two yrs and all courses must be closely related to the profession you choose on the SOL.


Now the process of onshore immigration involves the following steps.

1. Studying in a degree(s) closely related to a profession on the SOL for two yrs.

2. Applying for positive skills assessment from the relevant assessing body.

3. Obtaining a minimum of 6 in all modules of IELTS.

4. Scoring 120 in the points test.

5. Applying for PR.


If you are going to do an engineering course, then most probably your assessing body will be engineering Australia.

The problem is that Engineering Australia doesn't consider your masters degree for assessment. Engineering Australia considers your undergraduate degree for assessment.

So if your undergraduate degree is not an engineering degree, engineers Australia will not give you a positive skills assessment.


So there is no use doing an engineering degree in Australia if your undergraduate degree is not an engineering degree.

I dont know what your undergraduate degree is. So once I know what your undergraduate degree is then I will be able to give you a more clear answer.

Last of all, you cannot enroll in a MBA program because MBA is not closely related to engineering. As I mentioned earlier, all your degrees have to be closely related to the profession you chose on the SOL.

No you cannot get your PR just after one yr of MEM. You have to study for two yrs.

1.I have completed BSc(Bachelor of Science in Comp Sci) from Bangalore University and this is a 3yr course.

Job opportunities depend upon skills, work experience and abilities.

You cannot apply for PR after one yr of study. To be able to apply for onshore migration you need to study for two yrs in Australia.

No. The requirement of graduate skilled visa is also two yrs of study.


PS: If you want to save money, study for one yr, obtain a positive skills assessment as an IT professional, lodge an offshore migration application while in Australia, go back to your home country and wait for PR.

That way you save one yr worth of tuition fees.

As MIT is of 1yr, by the end of course completion if I take up another Masters for 1yr duration, totally it will add up to 2yrs.
So then I will be eligible for Graduate Skilled Visa Right??

How can I extend the VISA from 1yrs to 2yr If i apply to a new course?

What is the profession you will select on the SOL for migration purposes?

As an international student you can only migrate if the study you completed is

1. A 2 yr study
2. Your study is closely related to a profession on the SOL
3. The degree you completed is CRICOS certified.

So as a first step let me know what is the profession you will select on the SOL. You can access the SOL by visiting the following URL

Yes, then you would be eligible for 485 graduate skilled visa but then you would also be eligible to directly apply for 885/886 residency visa.

Why not apply for 885/886 directly when you have studied for 2 yrs any way.


How can I extend the VISA from 1yrs to 2yr If i apply to a new course?

Enrol in a new course when your first one is about to finish. Get the ECoE and send it to DIAC along with your application. You can do this online.

No FURTHER STAY is only imposed on visas less then 6 months in duration.

Normally , International students do not get No Further say imposed on their visas.

Whether you can apply for another visa if you have No further stay on is some thing I need to check.

I am aware that when I apply for a 1yr course to get a VISA I need to show funds for Tuition fees as well as Living expenses for 1yr.
If I want to extend the VISA for one more year getting enrolled in a new 1yr course, Do I need to show funds for Living expense and Tuition fee both or else Tuition fees alone....

The problem is that you will only get a new ECoE if you have paid the tuition fees.

So when you will apply for a new visa, you will already have paid the tuition fees. The only thing remaining would be expenses.

If you are holder of visa subclass 485, the next visa you are going to apply will be 885 or 886 permanent visa.

As you can see from the above requirements, there is no specific time period. You can apply any time as soon as you can score the pass mark in the points test.

If you can pass the points test without work experience, then you do not need work experience. However, I think the very reason you applied for 485 was because you couldn't score the pass mark for 886 or 885 visa and applied for graduate temporary visa so that you can get a job and get the required points.

So while having work experience is not necessary, it sure does help in getting extra points.

Well check the requirements given on the web link and see what exactly are you missing to score 120 points for 885 or 100 points for 886.

You need to discuss this with a good migration agent. Let me know if you need help with that.

Yes, as I explained earlier, he needs to have at least 7 in all modules to claim 25 points. Other wise he will only get 15 points.

Yes he will be short of what ever amount of points he is short of. I need to know his score to tell how many points he is short of.

In order for him to get points for spouse skills, you will need to fulfil the criteria given below

1. age
2. English language ability
3. qualifications
4. nominated occupation
5. recent work experience
6. has obtained a suitable skills assessment from the relevant assessing authority

So if you dont have work experience or skills assessment from the assessing authority then your partner will not be able to get you 5 points for partner skills.

The professions have been removed from CSL but they are still there on the SOL.

What matters is the SOL. CSL only determines the priority.

You can apply for any course you like. Whether a profession is on the SOL/CSL doesn't mean you can/not take it.

Yes, if you study some thing which is not on SOL then you cannot apply for PR.

I am not sure what you mean by mature age?

There are many courses of 2 yrs. You have to check the individual website of the college/uni to see whether a course is of two yrs or not.

Yes you can take 2 courses each of one yr.

yeah they are all registered in CRICOS..im studying at TAFE and they provided me like a package course which is certificate in supervision and a certificate in baking..they are all one year course.

They might be certificates, but are they trade certificates or not?

If they are

1. Trade certificates AND
2. They are closely related to each other AND

3. They are closely related to the profession you will nominate on the SOL AND

4. The total time of your study is 2 yrs

then you are eligible to apply for PR.

Well since that is some thing you want to do after your gain your PR, I would leave it for now and concentrate on getting PR first.

Yes thats correct. You can do pretty much any thing after PR.

Yes, that is what you should do if you want to save money.

First get PR and then study as much as you want.

Make sure the profession you nominate is a trade profession and not a non-trade profession.

It is the profession which you nominate has points.

Yes you can apply for PR once you complete two yrs of study.

Whether you get no further stay on your visa or not depends on the case officer and rules of those times.

But normally you dont get stamped no further stay if you applying for extension from within Australia do not get stamped No further stay.

No further stay is usually for those who are applying from overseas for durations lesser then 6 months.

That depends upon what you are studying and what exactly is the nature of your work. Do you cook some special type of cuisine or you just help with the customers.

So it all depends upon what you are studying and how much of the course is being used in your job.

Only in vacations. Other wise you cannot work more then 20 hours.

I will have to check whether you can work full time to complete the 900 hours work requirement as it is needed to obtain a positive skills assessment.

Yes you can extend your visa. You have two options

1. Ask your uni to give you admission in the next course and at the same time allow you to pass the subject you failed.

2. Just extend the visa and do the course you failed. Which you dont want to do as it is not feasible and you have to study the next course.

So the best way is to convince your uni to give you admission in the next course and allow you to pass the previous subject. So you will be studying one subject from your previous degree and one three more from your new degree.

Unfortunately you cannot study simultaneously in two institutes at the same time on an international student visa so this has to be done from the same uni. Either you can choose from the same uni or go to another uni and transfer all your credits which you have cleared.

Also, to complete your two year study you have to study in a degree or diploma. Certificates are not counted.

If you are doing a certificate from TAFE like certificate III etc. then the problem is that the immigration department will raise the objection that all the courses you undertook to complete the 2 yr study are not of the same level or not closely related.

You cannot do a one and a half yr masters degree and then do a certificate III from a TAFE just to complete the two yr requirement.

So the solution is to enroll in a diploma for one year and get an exemption based on previous study and complete the diploma in 6 months.

Anyways, I just want to ask you a few question so that you may be able to enlighten me in these circumstances.

1. Firstly, I would be applying to Australia for the sole purpose of PR. the following questions are in light of this.

I think you are planning for onshore immigration. As of now the current requirements are that you have to study for two years in a course closely related to a profession on SOL and then

1. Obtain positive skills assessment
2. Obtain the appropriate IELTS score requqired.

3. Score the required points on the points system.

Apply for PR.

Your course has to be of at least 92 academic weeks. You can check the duration of the course by visiting the CRICOS website which lists every course and its official duration.

You should also check what profession you would like to nominate on the SOL once you have completed your two yrs course. The profession must be closely related to the profession you nominate on SOL.

You should also check what are the pre-requisites set by the assessing body of the nominating profession.

Yes, your stay in Australia counts towards PR for onshore migration purposes as long as it is of two years academic duration.

If you already have 4 yrs of experience, I would suggest to apply for PR straight away. Of course get your assessment and IELTS first.

It is not guaranteed that you will get your PR application processed before your student visa expires. So better have backup plans.

You cannot apply for either TR or PR if you only study for one year. You need to study for two years.

Other wise you will have to apply for offshore immigration which would require you to get work experience. And since you do not have work rights in Australia, you will have to go back to your country and get work experience.

Yes the best option is to get a company to sponsor you.

Hey buddy . I got an admit into griffith university for environmental engg( 2 year course) My cumulative Ielts score is 8 but unfortunately i got a 7 for writing, so that means i get only 10 points right?

That is the case with all international students. Get extra in IELTS etc.

Look at other areas such as NAATI or becoming sponsored by a state.

As an international student you can only work 20 hours per week.

Full time job is equal to 37.5 hours per week.

So thats why you cannot apply for full time jobs.

While you are on a student visa, you can only work 20 hours per week.

Once you lodge your application for PR, you are awarded a bridging visa and then you can work full time.

For state sponsorship, you can get more information from the immigration websites of individual states and territories.

So in essence it means that only once we lodge/apply for pr can we work full time. But there is a catch isnt there? That is, I must first be eligible to apply for pr. And thats where the problem arises yea? Its getting tougher to get pr isnt it? For that i should ideally get 8 for each band in the ielts. please correct me if im wrong

No you do not get any points for having kids.

Please have a look at the Skilled Occupation List and first decide what profession CLOSELY relates to what you have studied.

If you think there is a profession on the SOL which is closely related to the studies you have done, then check what is the name of the assessing body which will give you a positive skills assessment.

Check the website of the assessing body and see if you can gain positive skills assessment or not.

If you can gain a positive skills assessment in a profession on the SOL that is closely related to what you have studied, in that case you are then eligible to apply for PR.

You have asked a million dollar question. If I can predict whether the rules will change or not, then I will be a millionaire.

Also, you must check what profession will you be able to obtain a positive skills assessment from after completing the degree you have mentioned from LaTrobe.

The best way to check would be to visit the website or your assessing body and check the details.

You are on the right path, but if your ultimate aim is PR than why do you want to waste around 40K AUD on MPH which is of little use to your wife's profession as a dentist?

Your wife will have to study for 2 academic yrs in a course and then after spending around 40K , she will have to apply for PR. Than she will have to wait for another yr till the application outcome is known. By than, you will have become broke ( unless you come from a very good financial background)

My best advice is that your wife clears the Australian Dental Council ( ADC) exam first. Then she can come to Australia on a student visa and while she studies, she also tries to get a job.

At least that way there is a chance of getting a job as a dentist.

My best suggestion to you is OFFSHORE immigration.

Onshore immigration, which involves studying for two years in Australia, is very costly and I have known a couple ( both dentists) who got so fed up that they left Australia after one year.

If your wife is studying an undergraduate course, than, you as as her spouse CANNOT WORK FULL Time.

You can only work 20 hours per week.

Whether you will be able to pay off your wife's tuition fees depends upon what you will be able to earn in the 20 hours per week salary and how much you will be able to save.

Your chances of obtaining a PR depends upon the following.

1. Your ability to score the pass marks in the points test for the visa category you have applied for.
2. Your score in IELTS.
3. Your nominated profession on the Skilled Occupation List, SOL and the number of years of experience in the nominated profession.
4. Your ability to obtain a positive skills assessment in the nominated profession from the respective assessing body.
5. Lodging the application correctly and filling the right forms.

You should ask the following questions.

1. What profession will you nominate on the SOL?
2. Would you be able to obtain a positive skills assessment in the nominated profession?
3. How much are you scoring on the points test?

There are two methods for Australian immigration.

Offshore and Onshore.

You can apply for offshore immigration by obtaining a positive skills assessment from ACS and obtaining the minimum required score for IELTS and scoring the right pass marks in the points system.

The question whether you can apply for Medical Lab Assistance based on your study as a Laboratory Technology depends on whether after studying your diploma, can you obtain a positive skills assessment for the profession of the Medical Lab Assistant?

If yes, then yes you can apply.

If no, then you cannot apply.

Also remember, that diplomas are only of one year. You need to study for two yrs to be able to apply for TR or PR.

Contact your assessing body and ask them to verify whether you will be able to obtain a positive skills assessment for the profession of the Medical Laboratory technician after studying the course you are planning to do.

If not it is advisable to change your course and study in some thing that is closely related to the profession you plan to nominate on the SOL for TR or PR.

By studying for two yrs, you only fulfill the two yr study requirement.

There are lots of other things that need to be taken care of before you become eligible for PR and can lodge an application.

You need to nominate a Profession on the SOL Closely related to your two yr study.

You cannot study cookery and then nominate mechanical engineering for lodging an application.

You also need to obtain a positive skills assessment from the assessing body which is responsible for assessing your skills in your nominated profession.

Please note that from the 1st July 2012, the Expression Of Interest register would be implemented and applicants would be hand picked and asked to apply for immigration.

So you might want to re-think your decision as it is not guaranteed that the Australian gov will invite you to apply for PR.

The SOL lists professions. Not courses.

The course you study needs to be closely related to a profession on the SOL.

Where did i say that? You can apply for PR directly if you are scoring the pass marks. You do not need necessarily need to apply first for Graduate skilled visa to apply for PR.

That is a good approach. Your aim should be to get both PR and a good degree.

The first thing would be to identify a profession on the SOL that you would nominate after your 2 yr study.

What profession would you nominate after your two yr study in Australia? What ever you nominate must be closely related to what you have studied for two yrs in Australia.

There are two problems.

1. Firstly, most of the MBA related professions on SOL require 7 plus yrs of experience which you don't have.

2. Secondly, from July 1st, 2012 , the EOI register is being implemented. Which means you cannot directly apply for PR after your studies. You will have to register your interest and if the Australian gov decides, they will invite you to apply. If they decide not to select you, you will not be able to apply.

So make your decisions carefully.

I started a MIT that was supposed to be 2 years so my visa was granted for 2 years but I applied for credits(for previous studies) and my course was reduced to 1 year and a half. So I'm thinking to do a diploma/certificate for 6 months. You stated before that in this case I will receive a 'NO LONGER STAY' on my visa. But my visa still expires in 8 months which is enough time to finishes the 6 months course. Do still i get the NO LONGER STAY condition? or can apply for the PR straight away?

I'll tell you about my particular situation. I am a local of Australia. My gf is a Chinese International student, who just completed her masters in accounting. I want to sponsor her migration here as my de-facto spouse. The problem is her student visa will expire just a couple of weeks short of the 12 month living together requirement!! My goal is just to get her to immigrate to Australia in the cheapest, fastest way.

I've done some research and I think the best approach will be to apply for a tourist visa (on the grounds that she wants to spend time with me), and then that will give me enough time to very shortly afterwards apply for the defacto PR (I'd apply as soon as eligible as I want her to be able to work). The tourist visa will result in a NO FURTHER STAY stamp.

My questions are will my idea work? - Can I still give her a defacto visa with the NO FURTHER STAY stamp (and a condition of the tourist visa is it is not for residence).
Also is this the approach you'd recommend?

Yes a visit visa will automatically end up in a NO FURTHER STAY condition being applied which means she would have to exit the country and then apply for another visa from overseas.

The best way out would be to enrol in another 6 months degree/diploma/certificate and complete the 12 months relationship period.

That way she would have work rights as well ( though only 20 hours per week and she would have to pay tuition fees as well) but she would not need to exit the country.

That is the only thing I could think of. You might want to consult a good lawyer who can think of a compelling reason to allow DIAC to give your gf a spouse visa before the 12 months period.

Such as you can show that she is financially dependent upon you etc.

Check with a good lawyer who can think of a good reason which can be used as a compelling reason to grant your GF a spouse visa.

Go through the SOL carefully and see if any other professions match with what you want to do and then study for 2 yrs in a closely related field.

But remember that the SOL can change any time so it is better to gain work experience in a profession on SOL from India and then apply for OFFSHORE migration.

You can take any course which is closely related to a profession on the SOL.

If you plan to study more than two courses than both courses must be closely related to the profession you plan to nominate on the SOL in the future.

Make sure that the graduation visa doesn't get stamped with no further stay either.

It seems that the visa for attending graduation ceremony is also a visitor visa with no work rights and a definite no further stay condition attached.

So the best is to enrol in a cheap course some where and then apply for an onshore spouse visa.

Studying for two yrs and completing your degree is one of the requirements to be able to apply for PR.

There are other requirements as well which you must fulfill to be able to APPLY for PR.

Make sure you are aware of all the rules. 2 yr rule is just one of them

Yes, you can.

Most students work part time jobs to pay for living and rental expenses. You should be able to do it as well.

I cannot predict how easy would it be for you to get a part time job.

She can apply on the basis of overseas work experience. But she must meet the following criteria. Please note that applications are by invitation only. To be invited to apply, a person must:

submit an Expression of Interest
have an occupation that is on the relevant skilled occupation list
have a suitable skills assessment for that occupation
be less than 50 years of age when the invitation is issued
meet the English language requirements
be able to score at least 60 on the points test.

Make sure that you first get a positive skills assessment from the assessing body before you lodge an expression of interest.

Also make sure you meet the work experience criteria for the profession nominated.

or,

Yes she can if she fulfills the per-requisites I have mentioned above.

The other way is to study for two yrs and then apply for PR but that is a very expensive and risky way.

It is very difficult to predict what the rules would be once you finish your diploma after 2 years time and whether you would be able to apply for PR on the basis of your diploma.

Firstly, under the current rules, International students can no longer apply directly for PR as they used to previously.

You will first need to lodge an EOI,

You can read up about EOI by visiting the following link

You must make sure you meet all the requirements of the EOI before you apply for the EOI.

Under the current EOI system, you will not get selected for PR just on the basis of your diploma. The current system values work experience.

So I don't think you would be able to get PR just on the basis of study as that option for international students have been closed out.

So basically, yes you can apply for PR but the process has changed.

I will try to simplify it by giving you an overview.

1) You first have to apply for a EOI. Read the article on EOI completely and see what is required for lodging a EOI.

2) If you are selected, you are invited to lodge an application for a visa. You must chose the visa that suits you and the one for which you can score the passing marks. Make sure you have read all the rules and the prerequisites of lodging the EOI and then lodging the visa application.

The problem is that the pathway of getting PR by studying for two yrs is no longer available to international students.

Once you finish your 2 yr study, all you get is a work visa after which if you cannot get PR, you have to return back to your country of origin.

In short, PR is no longer granted ONLY on the basis of study. You have to score points and fulfill some prerequisites to get PR.

You do not get PR based on what you study. You get PR based on your skills and how closely they match to the a profession listed on the SOL.

Yes, you can change your course before your arrival. Once you arrive, you can still change your course but you need to notify the department of the change in your course.

For your parents and siblings under 18, the visa categories on the following web link would apply.

Basically, there are two types of parent visa migration visas.

The one which costs under $2000 and takes 20 years to process.

And the one which costs $80,000 and takes 2 yrs to process.

For your sibling over 18 yrs of age, the easy and straight forward way is skilled migration.

There are other ways but very complicated and time consuming.

Just having degrees will not help you get PR. You need to have work experience as well.

You should read the current Australian skilled migration pathways by visiting the following link and understand what different pathways are available. Specially understand the concept of EOI and then lodging an application.

But this all depends whether you get an invitation through EOI first.

No use having the pass marks in the points test if you do not have a valid EOI invitation to lodge an application.

If you have two sisters who are citizens then you should consider applying for visa subclass 489. If your sisters live in a regional area then they can sponsor you.

You can only include your brother in your application if he is dependent upon you. Normally that happens if your brother is under 18 at the time of application or he is unemployed ( in that case you will have to show proof of income support).

My sisters can sponsor me too(they live in taylors lake,victoria)

The first way is to get sponsored by an employer on a 457 visa which allows you full time work rights.

Unfortunately, there is no other way other than studying a subject that is closely related to a profession on the SOL.

The graduate skilled visa 485 is no longer offered to international students.

There is talk of introducing a 4 yr visa but it has not been introduced as yet.

So your assumption that you will get work visa after 2 yr study is incorrect.

That option has been closed.

since this feb 2013 my husband has joined masters in health information management in Latrobe university.. initially myself and our two kids 5 n 6 yrs got dependent visa along with my husband..and we are also came here by April.. by the way he is a doctor n he needs to give his amc exams atleast 1 part to get temproary registration in Australian medical council and only for preparing for amc exams he has enrolled in masters but now he says he don't have sufficient time for amc preparation as this course demands most of his time and in other hand we are in situation of paying 8000 $ perkid for one year..now because of lack of time for amc preparation he is asking me to join some cheap course..so that he can change as my dependent.. I'm quit confused whether to take diploma in hospitality management, cookery course, or 2 year cheap masters course in IT (ive completed b.sc computer sci and helped my husband in hospital administration for 7 yrs) as we get 2 yrs work rights after this course completion.. our main wish is

to complete Australian medical Council exams

as we are more concerned about fees, can i take diploma or 2 year cheap masters course

I did not understand your question. Are you asking me whether you should go for the MBA or go for the MIS program?

What ever your choice is, it is really hard for me to advise you how good a course is without having any knowledge or information about the university or the course you plan to enroll in.

First thing to note is that you can no longer apply directly for PR after studying for two years.

Once you finish your studies, depending upon what you have studied, you will be given a 2 or 4 yr work visa. You will be expected to gain work experience relevant to a profession on the SOL while on work visa. Once that is done, you then need to apply for Expression of Interest. If accepted, you can then lodge a PR.

Please make sure you understand the new process.

If a profession is removed before you lodge an application for the profession then you cannot lodge a valid application as the profession has been removed from SOL. You will then have to gain skills assessment in another profession and then apply for PR based on the new profession.

Basically you first have to lodge a EOI and then if you are invited you apply for PR.

i did my masters from uk in biotechnology but since its difficult to get PR here so i have decided to move to australia and study visa is the only option left... i am coming for msc honours in biotechnology and mol bio in griffith university or la trobe university for july intake... which university according to you is really gud.. do u think biotech has scope there.. is it easy to find field related job... and wat about the pr scenerio... does this course comes under PR category... and Mphil option is there as well.. what according to you i should go for.. Mphil or msc.....

Just to clarify, there is no such thing as course coming under PR category.

There are professions on the skilled occupation list. Please check the SOL and let me know which profession matches closely with BioTech and I can answer further questions.

I did not understand your question. Do you want to enroll in a MBA degree or do you want to study accounting?

These are two separate degrees.

There is no such degree as MBA (account) and even if there is one then NO it cannot help you apply for permanent residency.

I am thinking of applying for PR before I complete my PhD since my current age is 43 (very unlikely that I will get point if I defer my PR application after my PhD). My questions are:

1. Will my bachelor degree qualification be still valid and counted for education qualification? Will it earn points for Australian Study?

2. How will my Masters Degree in Engineering which I completed overseas be counted in terms of gaining points?

3. Will DIAC accept overseas work experience which I discontinued a year back?

Yes your Australian engineering qualification is still valid and you can use that education for acquiring a positive skills assessment as well as towards the 2 yr study rule.

Yes it will fetch 5 additional points for Australian study (depending upon what visa you apply for and whether that visa has points for Australian study or not)

3. Is there anyway I can use my Master's Degree in Engineering from overseas in favour of gaining points?

You need to check with a lawyer whether you can claim points for Australian bachelor degree + Australian PhD degree + Overseas award at the same time or not.

Because you have Australian bachelor + Australian PhD so technically speaking you can claim points for both. But you need to verify that with a qualified migration agent.


3. Will DIAC consider my work experience that I have discontinued a year back?

Yes you can claim the following points.

Outside Australia: skilled employment in your nominated skilled occupation or a closely related skilled occupation


In skilled employment for at least three but less than five years (of the past 10 years)

5 points

In skilled employment for at least five but less than eight years (of the past 10 years)

10 points

In skilled employment for at least eight and up to 10 years (of the past 10 years)

15 points

My suggestion is to gain a positive skills assessment in your engineering profession and lodge one application ASAP so you can get points for age.

Once you complete your PhD and if your application is not decided you can lodge another application but in that application you will not be able to claim points for age assuming you will be above 45.

Yes you can apply for offshore immigration visa subclass 189 or 190.

However, you will have to first lodge an EOI and if invited you can apply for either one or both visas.

Please make sure you understand the requirements of EOI and also if you are scoring the pass marks.

You can apply for PR if

1) Your profession is on the SOL or CSOL.

2) You can get a positive skills assessment in your profession.

3) You score the pass marks for your visa.

4) You lodge an EOI and get invited to apply for PR.

It is not necessary that you apply for PR after studying for 2 yrs. You can apply for PR even without studying for 2 yrs.

Studying for 2 yrs is NOT THE ONLY pathway for PR.

Just because you studied in accounting does not mean you can apply for PR or you will get PR.

You have to fulfill the criteria I listed above. If you can do that then yes you can apply for PR.

You cannot apply for PR straight away after studying for two yrs.

That was before the introduction of EOI.

After studying for two yrs you can get a maximum of 4 yrs graduate skilled visa which allows you to work full time.

During this time you can gain work experience in a profession closely related to an occupation listed on the SOL and CSOL and then if you can score the pass marks, you can lodge a EOI and if invited you can apply for PR.

So the process has changed significantly.

You need to first lodge a EOI and if invited you can then apply for PR (assuming you fulfill the rest of the criteria and score the pass marks)
